Puea Thai to sue EC chairman


The Puea Thai Party will next week file a criminal lawsuit against Election Commission chairman Apichart Sukhagganond for not seeking the dissolution of the Democrat Party over the 258-million-baht donation case, party MP Prakiat Nasimma said on Tuesday.


Mr Prakiat, who chairs the party's legal office, said Mr Apichart had intentionally avoided requesting the Office of the Attorney-General to ask the Constitution Court to order the Democrat Party's dissolution.

The Democrats are accused of unlawfully taking a donation of 258 million baht from listed company TPI Polene through a third party in 2005, in excess of the 10 million baht maximum, and misusing the 29 million baht allocated by the EC for political development.

Mr Prakiat claimed that Mr Apichart, as the political party registrar, had clear information confirming the offence from the Department of Special Investigation and from the opposition's censure debate. The Democrat Party clearly had violated Article 94 of the Political Party Act.

The political party registrar was not supposed to do anything else but ask the Constitution Court, through the OAG, to order the Democrat Party dissolved, he said.

The Puea Thai MP said that Mr Apichart, in setting up a new committee to look into the case, had obviously tried to avoid taking action against the Democrat Party.

Kiat-udom Menasawat, the Puea Thai MP for Udon Thani who lodged the complaint against the Democrat Party with the DSI, would next week bring a lawsuit in the Criminal Court accusing Mr Apichart of dereliction of duty under Article 157 of the Criminal Code, he said.
